PRIVACY STATEMENT

This Privacy Statement, has been written acting in the capacity of data controller:

  1. Yemek Sepeti Elektronik İletişim Perakende Gıda A.Ş.,
  2. Yemek Sepeti Banabi Perakende Gıda Ticaret A.Ş, 
  3. Yemekpay Elektronik Para ve Ödeme Hizmetleri A.Ş., 
  4. Yemek Sepeti Teknoloji ve Online Hizmetler A.Ş.,
  5. Delivery Hero Teknoloji Hizmetleri A.Ş.

(“Yemeksepeti” or “Yemeksepeti Group”)  in order to inform employee candidates (“Candidates”) and make detailed explanations on the processing of their personal data by Yemeksepeti in accordance with the Law on Protection of Personal Data numbered 6698 ("Law").

Personal Data Collected and Retention Period 

Your personal data based on the following categories that you will submit to us within the scope of your job application are as follows:

Contact Information: Address number, e-mail address, contact address, phone number, travel and ticket information etc.

Transaction Security: IP number, system login-logout information, password information etc. 

Professional Experience: Resume/CV information that you send directly to us or transmitted with your approval, or resume information that reaches us through third-party platforms, diploma information, courses taken, vocational training information, certificates, transcript information, tests-exams- assessment notes during the interview, etc. 

Visual and Audio Recordings: Visual and audio recordings etc. 

Health Information (For Disabled Candidates): Information about disability status, blood type information, personal health information, device and prosthesis information used etc. 

Your personal data that you will submit to us within the scope of your job application will be stored in our system for 2 (two) years within the scope of the following specified purposes. 

Purpose of Processing of Personal Data

3.1. Your personal data within the scope of your job application will process following purposes and limited to these purposes and in a limited and measured manner 5th provision of the Law “If it is necessary to process your personal data, provided that it is directly related to the establishment or execution of the contract between you and us", "when there is an obligation to fulfill our legal duties. and “to the extent that it is made public by you (to the extent that it is compatible with your publication purpose)”. 

  • Planning the human resources processes of the Yemeksepeti, executing the personnel recruitment processes, planning and executing the employees' access to information
  • Within the scope of ensuring the legal, technical and commercial job security of the company and the persons who are in business relations with the Yemeksepeti; planning and execution of the operational activities required to ensure that the Yemeksepeti activities are carried out in accordance with the Yemeksepeti procedures and/or the relevant legislation, providing information to the authorized institutions based on the legislation
  • Within the scope of carrying out the necessary work by our relevant business units for the realization of the commercial activities carried out by the  Yemeksepeti and conducting the related business processes; establishment and management of information technology infrastructure

3.2. Your sensitive personal data within the scope of your job application, that is, your health data, association, foundation and union membership data you can provide during your interview with Yemeksepeti, your data on criminal convictions and security measures, keeping records stipulated by laws and conducting personnel recruitment processes in order for Yemeksepeti to fulfill its obligations arising from the legislation, can be processed within the scope of explicit consent pursuant to Article 6 of the Law. In parallel with the care and distinction shown in the Law, a sensitivity beyond the above is shown by the Yemeksepeti Group in the protection of personal data of sensitive personal data, which is determined as “sensitive” by the Law and processed by the law, in addition to the distinction shown in the Law.

Method and Legal Basis of Collecting Personal Data 

Your data within the scope of your job application is obtained based on your consent if you transmit it directly through Yemeksepeti Group tools or through third-party platforms you use. You may also receive information via SMS or WhatsApp regarding your application.

Your personal data are collected at the time you come to the job interview, by means of your resume, application form and personality inventory form, in a physical or electronic environment (through the authorized job application platforms we have developed, used, etc.). Your application will always be reviewed by a human being. We do not rely on solely automated decision-making to conduct our recruitment activities. Your personal data can be processed and shared in line with the legal reasons and purposes in the 2nd Article of the Privacy Statement specified in detail above.

Parties to whom Personal Data may be Transferred and Purpose of Transfer 

Your personal data collected by Yemeksepeti may be shared with our domestic affiliates, shareholders, business partners, competent public authorities, and natural persons for the purposes detailed in Article 3 of the Privacy Statement above and based on the legal basis stated in Article 4, in accordance with Article 8 of the Law.  For the same purposes and limited to these, your personal data may be shared with our abroad subsidiaries, shareholders and business partners within Delivery Hero Holding, to which we are affiliated, in accordance with Article 9 of the Law, with your explicit consent. 

Your Rights Regarding Your Personal Data

You are accorded the following rights regarding your personal data:

  • To learn whether your personal data is processed or not;
  • To request information in case your personal data has been processed;
  • To find out the reason for processing of the personal data and whether this has been used properly for that purpose;
  • To know the third parties to whom your personal data has been transferred at home or abroad;
  • To request for the correction of personal data if it is incomplete or incorrectly processed and to ask that the process carried out in this context be notified to the third parties to whom personal data has been transmitted;
  • To request deletion or destruction of your personal data if the reasons for processing the same have ceased to exist although it has been processed in accordance with the Law numbered 6698 and other relevant laws, and to ask that the process carried out in this context be notified to the third parties to whom personal data has been transmitted;
  • To object to any unfavorable result suffered due to analysis of processed data exclusively by means of automatic systems; and
  • To demand compensation of your loss if you incur a loss due to illegal processing of your personal data.

As a personal data subject, you may submit your requests about your rights to info@yemeksepeti.com. Applications that do not meet the criteria determined by the Personal Data Protection Authority under the respective legislation will not be taken into consideration unless additional information to be requested from you is completed in order for them to meet the criteria. 

According to the nature of the request, Yemeksepeti will conclude the request free of charge as soon as possible but in no later than thirty days. However, we would like to remind you that in case any additional costs arise from the fulfillment of your requests, the fee in the tariff determined by the Personal Data Protection Authority may be charged.

Yemeksepeti reserves its right to unilaterally update this Privacy Statement in case any business requirements or legal requirements arise.
